Appeal court rules Dutch cafes and bars must close down smoking rooms

Cafes and bars will have to close their special smoking rooms, which they set up when the ban on smoking was introduced in 2008, appeal court judges in The Hague said on Tuesday.

The case was brought by Clean Air Nederland which argued that by allowing special smoking rooms, the Netherlands was breaking the terms of an agreement with the World Health Organisation.

In that agreement, the Netherlands said it would take steps to stop people being exposed to tobacco in ‘indoor public places’. The court has now ruled this also applies to smoking rooms in cafes and bars.

The court said that non-smokers could feel social pressure to join smokers in the smoking areas. In addition, smoke unavoidably escapes from the rooms and that cafe staff who have to clean them also become exposed to tobacco.

‘This is dangerous, because it has been established that there is no safe level for exposure to tobacco smoke,’ the court said in its ruling.

The court did reject part of the case in which CAN argued for a ban on smoking rooms in other public buildings, saying it had not provided enough evidence.

Dont know what to make of this? I take it Coffeeshops still avoid it due to the "pure weed no tobacco" aspect and would this spell an end to somewhere like Batavia being a smokey haven!?

Does anyone know whether this take immediate effect and i also assuming this only applies to bars/cafes rather than coffeeshops themselves , (pure joints)

Im heading over in just over a week. :D Don't see this as so much of a problem in the summer but its too cold at the minute.

This happened here years ago ,thought it would kill bars but it made experience far nicer .
Before the law , on dart night we would say we where going to bank machine ,smoke joint
After everyone had to go outside to smoke ,it was easier just stand outside and blend in with ziggy smokers as the coppers cruised by . With all the smokers stepping outside in the Dam should make us potheads a little more unnoticed by locals :D

It is technically illegal to smoke Cannabis on the streets in Mokum afaik and although it apparently isn't policed very much I bet that that would change quickly if every other bar had a group of stoners crowding around outside the front door passing fat joints around... If you think bars will keep an option open for smokers of pure weed alone I think I you are kidding yourself. No, this is a disaster right around the corner, very likely to kill off one of the remaining few things special about the place.

Another thing is bongs, dabs etc., I have a very hard time believing that many places will be ok with you pulling out a two footer and start slamming the bowls down 8n a non-smoking place, let alone allowing you to stand right outside their establishment slinging the glassware or heating the nail to drop some globs...

Next rules will be so far from front door and no standing under canapy,s or outside patio with roof .
I will tell you this does work ,people get sick of going outside in cold weather.
It,s amazing how treating ziggy smokers like second class citizens works .
In ten years there,s been huge number of people who have become none smoker,s this does work .

But the general EU rule is that you cannot smoke in public places (bars and shit) unless those places have designated smoking rooms/places only for smokers. If the place doesn't have one inside, people go outside. Simple as that. But banning everything is always simple in our modern socialis...democracy:D

Gov't wants to close smoking areas in Dutch restaurants, bars within two years: report

The Ministry of Public Health Welfare and Sports wants to close all smoking areas in restaurants in bars, restaurants and other catering establishments in the Netherlands within two years. State Secretary Paul Blokhuis will announce this on Friday, sources in The Hague told NOS.

Blokhuis is responding to a court ruling in a lawsuit filed by Clean Air Nederland. In February the court ruled that all smoking areas in restaurants, bars and cafes must close.

The Netherlands banned smoking in restaurants and the like in 2008, but added an exception for specially designated smoking areas that must comply to certain rules. The court now ruled that this exception for smoking areas is contrary to the World Health Organization's rules on combating tobacco use.

Blokhuis went into cassation against the ruling, because he disagrees with a technical detail in the ruling. This is mainly a stalling tactic, so that Blokhuis can prepare the catering industry for closing their smoking areas while the Supreme Court considers the case, according to NOS. If the Public Health State Secretary hadn't gone into cassation, the smoking areas would have to close immediately.

No Wlow, this is a disaster that will most likely kill places like Batavia, hsb, Kashmir lounge etc. and could also very well mean the end of smoking anything what so ever in coffeeshops since it's not possible to guarantee that no baccy is sneaking into people's joints...

spoken by a true non smoker... infact i would be willing to bet a EX smoker, right?

so how about no drinking alcahol in resturants? i shouldnt have to put up with drunk people in public while im trying to eat with my kids.
also no football in bars, i shouldnt have to listen to rowdy people shouting off while im trying to have a quiet drink....
infact maybe everyone should just stay home.
ridiculous.
as is said above this is a slippery slope where it may be legal to buy weed but you dont have anywhere you can legally smoke it, places like batavia and hsb close but also coffeeshops are smoke free, this could well spell the end of cannabis tourism in amsterdam.
only users loose drugs
