Amsterdam, The Netherlands (April 16, 2012) – Cannabis entrepreneur Arjan Green House takes Dutch state to court on charges of violation of the Dutch constitution.

(Amsterdam) New proposals for anti-drug laws in The Netherlands call for restrictions being placed on who can buy cannabis in infamous Dutch coffee shops. The Dutch government is trying to set up a system that judges people by ethnicity and nationality in violation of the Dutch constitution. Far-right politicians have proposed legislation that would only allow Dutch residents to enter cannabis-selling coffee shops. This legislation would require Dutch residents to register as members of the cannabis-selling coffee shops and would prohibit any foreigners from becoming members. The membership system, also known as the “weed pass”, is not supported by any of the Amsterdam political parties besides the Christian Democratic Party.

Together with a legal team of 4 well-known cannabis-business-branch lawyers, Arjan Green House (a well-known cannabis entrepreneur) has decided to take the Dutch state to court, claiming the new legislation is a violation of the Dutch constitution. According to Arjan “the introduction of the weed-pass, and banning tourists from coffee shops would only be possible through local regulation on the grounds that the visitors of coffee shops create a public disturbance. The legislation as proposed by the Dutch state calls for a national ban on tourists in coffee shops, however if the local municipality is against the legislation it is not possible for the Dutch state to enforce such a ban.” Arjan continues to explain, “Artikel (or) Clause 1 of the Dutch constitution states that all that are in The Netherlands will be treated equally, discriminating based on religion, lifestyle, political views, race, gender on any ground is not allowed. For this reason, the national ban on tourists visiting coffeeshops would violate our constitutional rights here in the Netherlands by discriminating against foreigners.”

Arjan Green House and his legal team are scheduled for a court hearing on the 18th of April 2012 where they will challenge the Dutch state for violating the Dutch constitution.
its not just the greenhouse, its all of us,most of the coffeeshops in holland are fighting the state, its all one case starting tomorrow, this is the real fight, involving all the coffeeshops and cannabis bonds in the netherlands, surprised seen no mention of it on lunks coffeeshopnews site?

Just saw the other posts about the event tomorrow after writting this.

Whatever:

Was in Eindhoven yesterday: three of four visited shops preparing for the introduction 1st of May.
One again mentioned this hearing(at a council/court or whatever, means coffeeshops arguing against the Wietpas at this ominous council) on 18th of April but doesn't really expect anything,
'Just a formality'. One wasn't sure.

Almost sure it will be introduced coming May Image !

As 'Hope dies last' I will have a look at this thing in Tilburg before introduction and will report back.

The ultimate goal is to close all coffee shops, the weed pass is just a (slower) means to an end.
The proof or resource I was asking about was in ref. to moving shops outside of the city. I thought perhaps you had a source.
There is no subsidizing or locking of real estate or devaluing...
I think in recent years the value of real estate in Amsterdam has been at an all time high, and will continue to climb. \
Look at the selling price of a canal house 10 years ago, less than 500,000. Today, good luck with finding one for under 1mil...
No real estate problems because of shops being closed, just the opposite.
Watch and see how quickly the spaces are taken over where all of the Rokerij shops were located, esp. the one on the corner of Haarlemerstraat.

The end is near for the coffee shop culture as we know it. I don't like it, you don't like it, but it is reality.
One last tid bit..... Some here need to be reminded that they aren't Dutch, it's not their country, and maybe they should turn their focus and energies in changing their own country.
Hmm, there might be something to this...
What is the prevalent reason why the world dislikes America? Capitalistic Expansionism. Stoners are no different.
If a majority of a society doesn't want cannabis, stop trying to force them to accept it.
If a majority of a society wanted cannabis to be legal, it would, all things considered.

I can't wait for 2 Jan 2013. Then maybe some can finally get a life.
Nah, some don't know how to stop whining about (mis)perceived social injustices.
Happy trails...
ok uncle ron ,again, thanks for response. our debate on "locking up" real estate reminds me of the cool hand luke video you put up earlier in the thread. let me try again because i am not sure by your response you understand what i am saying in that regard. i am saying that the government hopes by kicking out foreigners , limiting amount one can buy per day , limiting shops to a certain amount of customers and discouraging customers by forcing registration, that the coffeeshops will become unprofitable and will have to go bk and close. they would have to then give up their lease, sell their real estate or give up license and start a new business.. i am saying through benefit concerts, george soros types who favor legalization, and coordinated donations from stoners you subsidize the individual coffeeshops or at least some in the most prime of real estate . like as in coffeeshops say "hey , we dont have to go bankrupt because we get this extra funding. we can stay in business even though we have very few customers and should go out of business in traditional scenario. now we can keep the coffeeshop and the license and are open for business for as long as we get our donations, subsidy for the stoner community and benefactors" see you are now allowing a bunch of unproductive coffeeshops to retain their presence and allow a bunch of unproductive real estate to sit in hollands prime locations in the hopes that they will eventually change the law back so that they can go back to business as usual and we can withdraw our financial support and allow them to survive on their own again.. secondly, your statement about trying to force cannabis on the majority of society of society that does not want it is kind of off the mark. i would say the right to ingest into your body what you want is pretty much a fundamental human right. would slavery have been voted down in a majority rules vote, how bout interracial marriage, gay marriage ,right to abortion ,right to burn US flag etc.our civil liberties should never be put to the vote of a usually stupid majority.

i am going to butcher this quote but it goes something like this.. a reasonable man adjusts to his society an unreasonable man adjusts his society to fit him. therefore we are dependent on the unreasonable man for all progress... anyhow i think the boycott could work.. everyone else does not . i think others have done more incredible things with protests , boycotts etc .that would have been thought impossible but fuck it . as for the save the coffeeshop idea by subsidizing them with donations, attracting big time benefactors who favor legalization(like soros) and benefot concerts from bands etc. i think it is a great idea that is remarkably easy to carry out. why? well, if the letter writing etc fail the coffeeshops will be greatly reduced . i am pretty sure we agree on that. when that land is sold or leased to others because the coffeeshops can't afford to stay in business. it is pretty much gone forever. if they do eventually change the laws back and allow coffeeshops to survive once again , from the locations they put "sinful" locales in the us like industrial parks and crap unincorporated areas in the middle of nowhere, i can predict that the netherlands will do the same. they will not be able to buy back into the areas that they lost as they would probably be more expensive or the government may create new restrictions on where to operate. by subsidizing the money losing coffeeshops in my scenario we have the added benefit of letting the government take heat from the merchants of the area as many now low foot traffic coffeeshops remain that don't attract tangential customers to their shops. this will prove another hurdle for the coffeeshop foes in my opinion. will they eventually make another law to force them to close.maybe they will. however, they have to more readily uncover their true intention which is to destroy the coffeeshops and take away this right from their own citizens

Assuming the coalition lasts, I believe the next election will be in June 2014 by which time the commercial and social effects of the Weitpass will be felt, especially in the capital and towns that enjoy tourist trade. With most conservative supporters, moralising finger wagging usually gives way to free trade when it hurts their pockets.

As many on this board have pointed out the cliché of the dope smoking tourist as a penniless back packer is wide of the mark. Many of us have been there but still enjoy Amsterdam with a much larger budget. It is a great city but without the weed I might as well get a train to Antwerp or Ghent , which have better beer with the same atmosphere about them.

Ironically the weekend stag pissheads looking to shag whores will still go to Amsterdam and there will be a growing black market of dealers to serve that easy demand, taking Amsterdam backwards as far as street dealing is concerned.

Also interested to know if you are a resident for a few weeks, working in Holland, whether you could get a temporary Weitpass?

these coffeeshops are making BANK... in cash (much of which they probably never declare)... they should have no problems getting together and hiring a team of REEAAAALLY good attorneys.

AFAIK they propose to introduce it on the basis of nationality rather than residence. Of course, the entire proposal is badly thought out anyway, not just this small part.

19 coffeeshop owners were represented in court today apparently. And the ruling will not be until 27th April 10am, I wrote a little something about it here:
http://www.weedandhash.com/19-coffeesho ... e-wietpas/

In my view, this wietpas is not going to happen immediately. There is going to be some major disobediance by all the coffeeshops. Then we'll see what the government will do. Maybe it will end up like the dispensaries in the USA where Amsterdam council wants its coffeeshops to remain operating the same way but the Narcotics police occasionally do a raid. Test cases will follow and its going to be messy and take a long time, whatever the outcome.

Interesting if all Amsterdam CS did this. The project would just fold.
Laws only work if their wanted. Realise that some want this around Netherlands
but not so in the Dam.
Think they should all just not comply...
Dress it up as a civil liberties issue and conspicuous discrimination of non-Dutch people...
As I said, CS owners should just not comply...
There is no way they have enough time, police, means by which to enforce...
